Common Law Marriage in Alabama Ending in 2017

When thinking of marriage in the traditional sense, there are two components that come to mind. There would be a ceremony conducted by a public or religious official, and a marriage license would be established. A common law marriage is a relationship with the absence of those two elements. The AL legislature abolished common law marriages, effective January 1, 2017. Problems sometimes occur when only one party acknowledges the relationship as a marriage, particularly as it relates to marital benefits. In these instances the courts are challenged to make a determination of validity, which invites evidence which may be largely speculative and open to interpretation. Representative Mike Jones (Andalusia) introduced the bill and Governor Bentley has signed it into law. Common law marriages achieved prior to 2017 shall remain valid.

New Year’s Resolution – Drive Less Distracted in 2017

In Baltimore, a man crashed into a stationary police vehicle while playing “Pokeman Go.” In Napa, a teen driver collided with a power pole while playing a video game. Jennifer Smith founded a group called StopDistractions.org to advocate against distracted driving after her mother was killed in an accident caused by a distracted driver using a mobile device. According to the National Safety Council, roughly 1.6 million auto crashes are attributed to mobile phone usage annually; this equates to approximately one of every four incidents. An estimated 330,000 people are injured in accidents stemming from this issue. They believe the average time that a driver takes their eyes off of the road when text messaging is five seconds. Distracted driving may include actions such as mobile device usage, eating, using mirrors to view makeup, and more.
